Mandatory Process for EPFO Compliance

Please be informed that obtaining the 'Declaration Form in Form-11 (New)' (please find attached), duly filled by the members at the time of joining and seeding the KYC details in the UAN portal of EPFO, will be a mandatory process as per the circular issued by the PF Commissioner recently. Hence, employers may receive a call from the respective Regional PF officials for the following directives:

- **Declaration Form Submission:** Employers of establishments covered under the Act are directed to obtain the declaration in Form No. 11 (New) from all employees joining the establishment in a month who are eligible to become members of the Fund. This must be uploaded to the UAN portal within 25 days of the close of each month.

- **UAN Dissemination:** Employers are directed to disseminate the UAN generated by EPFO to all existing employees who are members of the Fund within 15 days from the receipt of the UAN and obtain acknowledgment from them.

- **UAN Activation:** Employers are directed to ensure that their employees who are members of the Fund activate their UAN within 15 days of dissemination.

- **KYC Details Seeding:** Employers are directed to duly seed the KYC details of such members (such as bank account details, PAN, AADHAAR, etc.) within one month of the receipt of the UAN to enable them to avail of services from EPFO.

- **AADHAAR Seeding:** Employers are directed to seed AADHAAR numbers for members who have AADHAAR within one month of receipt of the UAN. If a member does not have AADHAAR, the employer must obtain a certificate from such members of the Fund stating that they do not have AADHAAR within one month of receipt of the UAN. Once AADHAAR is submitted by any member, the employer is directed to upload it to the UAN Portal within 15 days of receipt.

- **Incorporation of UAN in Claim Forms:** Employers are directed to ensure the incorporation of UAN and to seed all relevant information in the claim form before forwarding it to EPFO.

I wanted to know how long it takes for a UAN to be generated from the PF office. In my last organization, I was coordinating with the PF agent before I resigned. I had provided the relevant details to the PF agent for UAN and KYC, but to date, none of us have received our UAN numbers. After my resignation, the accountant is now handling it, but he is another person who piles up work and then blames others later for things not done.

  • We have received a similar mail from the PF office. However, how can the PF office make the Aadhaar number mandatory when the Supreme Court has clearly stated that no employee/citizen can be denied benefits if they do not have an Aadhaar? I think it also stated that government bodies cannot make Aadhaar compulsory. This is what I had read in the news:

    "Rejecting the government's plea, the Supreme Court said it will now have to publicize widely that the Aadhaar card was not mandatory. It also ruled that no authority shall seek Aadhaar cards from citizens to accord any services."

    Then why is the PF office (and ESIC too) making Aadhaar mandatory? I hope seniors may please give their thoughts on the issue.

    I am working in a small engineering firm where 15 employees are currently employed. We provide manpower services to other companies. The company asks our employees for their PF numbers. If they do not have a PF number, they are required to submit a declaration. Can anyone guide me on this, sir?

    Dear Seniors, I am a very old member of this site and wanted to procure some information. Actually, one of my friends has got an EPF establishment code. However, during the time of ECR registration, he was not diligent enough to register his establishment. Now, after motivating him, he is interested in regularizing and complying. How could he obtain the registration of his establishment in UAN II version? If someone has a solid idea or hints to fix this problem, I would be highly obliged to receive the answer via email. I am looking forward to your kind and early response.
