Clarification on BOCW Act Section 40(e)

"As per BOCW Act Section 40(e), the erection, installation, use, and maintenance of hoists, lifting appliances, and lifting gear, including periodical testing and examination, and heat treatment where necessary, precautions to be taken while raising or lowering loads, restrictions on the carriage of persons, and appointment of competent persons on hoists or other lifting appliances." I am very happy with Indian acts and rules, but the thing is I am just confused with some rules (like the one I mentioned above). My question is, in the above section, by whom should the lifting equipment be certified, and what are his qualifications?

Dear Jakeer12,

Tests and periodic examinations of lifting appliances are to be carried out by a competent person. A competent person is an individual approved by a State Government, possessing adequate qualifications, experience, and skills for the purpose of testing, examining, or certifying lifting appliances, lifting gear, wire ropes, pressure plant, or equipment, etc.

Dear Madam,

You are requested to pull out the certificates issued to you in this regard and see who has issued them to you. I am not an expert, but I have a question for you: how can a structural engineer issue you a certificate for tests or periodical examinations of lifting appliances? In my opinion, the examination of lifting appliances or tackles falls under Mechanical, Electrical, or Metallurgical Engineering, not structural or civil engineering. I may be mistaken. Please correct me if I am wrong.

Dear Sir,

We have conducted a periodic examination through a person approved by a State Government. I may have been mistaken about his qualifications as a Structural Engineer. His qualification is ME. He provided us with Form number 11, which is prescribed for the report of examination of lifting machines, ropes, and lifting tackles.

I have Form no. 11. Please provide me with your email address if you require a copy of the same for your reference.

Dear Rupali ji,

Thanks for reverting. The signing authority, i.e., a competent person, may be a ME in Mechanical, Electrical, or Metallurgical fields but not in Structural or Civil Engineering. A Structural or Civil Engineer cannot be considered a competent person for the examination of lifting appliances/tackles, based on my common sense. I once again admit, I may be wrong. Other experts are requested to comment.

Dear Sir, You are correct. Qualification of our competent person is BE Mech.( Chartered engineer competent person.)
