I am a probationary officer in a PSU bank and have completed 1 year of probation. Recently, my husband met with an accident and is now paralyzed from the waist down. Since I belong to Lucknow and am posted in Varanasi, it is not possible for me to take care of my husband. For the past 2 months, I have been going back to Lucknow on weekends. This back and forth, along with all this emotional stress, is taking a toll on my health.

I have informed my management regarding my problem and also submitted a transfer request. However, they are adamant that I will only be transferred after 3 years. I understand that I can't pressure them to transfer me. Therefore, resigning seems to be the only option left. I am not in a position to pay 2 lakh rupees, so I want to know if there is any way I can avoid or perhaps pay a lesser amount.

Have you read the compassionate posting policy of your bank?

Check out regarding resignation on medical problems of dependents. I am sure there must be some clause which permits exits without bond money on genuine cases of this nature.

Thank you for your suggestion. When I came to know about the medical condition of my husband, I immediately talked to the GM of the HR department. He said to submit a transfer request and all the relevant medical certificates of my husband and told me he would look into the matter. However, four months have passed, and now whenever I try to reach him, he is unavailable. I tried to talk to the CMD, but his assistant told me to speak to the GM of personnel. Her assistant gave me this rude reply that everyone is having problems; you are not alone. I even talked to people in the union, but they also gave me vague assurances. My superiors are saying that if I don't pay the money, the bank can sue me. With everything happening, I can't have a court case also.

Request for Compassionate Transfer

I am writing to describe the difficult situation I am currently facing. As you have the authority to transfer employees on compassionate grounds, I kindly request you to consider retaining my job to the best of your ability. One possible solution could be relocating my husband to my current place of assignment and allowing me to wait for the transfer.

I believe that time is passing quickly, and I hope for a swift resolution.

Engaging in litigation at this point would likely escalate the situation. According to sections 73 and 74 of the Contract Act, the bond amount payable should be a reasonable proportionate sum based on the expenses incurred during my training. If no resolution is reached, I respectfully ask the management to determine an appropriate bond amount.
