It is proposed to add in the draft of Mr. Nathrao the words "and violation of it will be treated as misconduct" after the word "prohibited" to be more precise in terms of the apex court decision in Glaxo Laboratories of 1984, wherein it was held that action can be taken against acts of misconduct and none else.
Further, in order to make it applicable to workmen, Section 9A of the ID Act notice has to be given. Furthermore, where standing orders are applicable, an amendment in the S.O. has to be done as per procedure.
