Accident Report Form for ESIC
1. The Accident Report form can be downloaded from the website of ESIC or from the website of the appropriate office of ESIC to which your unit is attached. The said Accident Report can also be submitted online as per the procedure set up by ESIC.

Assessing the Severity of the Accident
Firstly, determine whether the accident is serious or not. If it is severe and has injured a part of the body resulting in the disability of the worker, then you must inform the local office and submit an online form on the ESIC site within 24 hours.

In order to report an accident in ESI, you need to have the following details:
1. Date of Accident
2. Location of Accident
3. Start time & end time of shift
4. Exact place of accident
5. Cause & nature of accident
6. Nature & extent of injury
7. Details of doctor who treated the patient
8. Witnesses (2 nos) & their contact details
Once you have all the above details, log in to the ESIC site and create an accident report (form #1) in the name of the IP. You can take the printout of the accident report and hand it over to your ESI local office. You need to do this within 24 hours of the occurrence of the accident in order to get the benefits for the employee.

Injuries caused to an insured person (IP) due to accidents during the course of employment are to be construed as "injury due to an accident" and are covered, entitling them to every available ESI benefit. As he was in the company's cab and met with an accident en route, it's a clear-cut case.

Mr. Harinandan has rightly advised you regarding the submission of the accident report. It is obligatory on the part of the employer to report all accidents arising out of and in the course of employment within 48 hours in ordinary cases and immediately in death cases. The accident report should be prepared in triplicate; one copy should be sent to the local office, the second copy to the Insurance Medical Officer, and the third copy retained as office record. A copy of the Accident Report is attached for your necessary action.

1. Accidents can happen anytime and anywhere. However, to be treated as an employment injury, the accident must occur out of and in the course of employment. An accident can happen even on the first day of employment or within a few days when no contributions under the ESI Act, 1948, have been deducted and paid by the employer.
2. It is essential that the injured employee is on the attendance roll of the employer, their declaration form has been submitted by the employer, and an insurance number has been allotted. Otherwise, it will be difficult to get benefits under the above Act.
3. The injured employee or their family members should contact the employer to ask for the insurance number and ensure that the employer has submitted the accident report to the ESIC Branch Office and the appropriate ESIS dispensary to which the employees of the unit are attached. In such a situation, the injured person can obtain a medical certification from the ESIS dispensary and also benefits from their ESIC Branch Office.
4. I believe that ESIC authorities will not reject the case if the employer has obtained the insurance number of the injured employee and has submitted the accident report. The injured employee or their family members can appeal to the higher ESIC authorities in your area in case there are any grievances.
