_If employment letter is issued to a worker by contractor, then even if on first day of employment, worker is injured, ESI benefit will be admissible to that worker_

(Refer FAQ No. - 37 of ESI)

*inspite of fact that worker is not registered with ESI authorities.*

Not only accident benefits but medical benefits are also available from the day one of employment. If not registered for want of documents, the injured will get the benefits. But without registration you cannot upload the accident report in the ESI portal. Therefore, immediately after the accident, register him and then upload the accident report.

An employee can be registered within 10 days of his joining, but this does not mean that you should wait for 10 days.

The registration can be done in 10 days time - refer circular dated 03.12.2019 of ESI). It means the employer has to complete the registration within 10 days.
In absence of registration, the employer has to borne the claim in case of any accident.
Many PSU's and big industries don't give entry or Entry Gate Pass, if the employee or workman does not have ESIC registration. Therefore, the employer should do the necessary registration prior to joining to avoid unpleasant future situation.
