Hello everyone, In our factory,raw material store and admin office are inside the premise. so admin office and R.M store will be under factories act or shops & establishment act?

Hi.. It will comes under Factory’s Act. If Admin office & RM store is not related with factory’s operation then it will comes under Shops & Establishment Act. Regards

  • All the offices situated within the factory precincts/premises will be covered under the Factories Act. If an office belongs to a factory established in a nearby town/city, then it will be covered under the Shops and Establishment Act for the purpose of licensing from the Labor Department only. All the other labor acts will apply on par with factory employees.

    It cannot be so. If a premise is an establishment covered under the Shop Act, it is so not only for the purpose of registration but for all provisions of the Shop Act. Usually, if a factory has its offices outside the factory premises, they will be, for the sake of the law, under the Shop Act. However, other working conditions will be the same for its factory and offices, especially if the staff are transferable.

    If an administrative office is running within the premises of a factory, it does not need a license under the A.P. Shops and Establishments Act of 1988. However, if a factory is located on the outskirts of a town and its office, meaning the company office, is in the town, then it is necessary to apply for a license under the AP Shops and Establishments Act.     Whatever office, process, storage or any other activity are within campus of the factory, on all these provisions of the factory act would be applicable barring exceptional cases.
