When I joined the company, the notice period as per the agreement I signed was 45 days. However, after 7 months of joining, the company extended the notice period to 90 days and notified all confirmed employees via email about this change.

Now, as almost a year has passed since my joining date, I am wondering if the company can legally change the notice period retrospectively.

Policy Applicability for Confirmed Employees

The date cannot be retrospective, but based on the information provided, this policy will apply to all confirmed employees. Hence, starting from the date the mail was received, all employees confirmed up to that point will need to adhere to a 90-day notice period.

Importance of the Confirmation Clause

The inclusion of the confirmation clause is essential due to the possibility of a higher number of confirmed employees. By stating that the policy is applicable to all confirmed employees, it clarifies who falls under this requirement. Therefore, if you are already a confirmed employee, your notice period from the date of the mail will be 90 days.

I hope this clears up any confusion.

Yes it is applicable to you too once you get confirmed. If you are under probation the applicability of Notice Period will differ.

I second the opinion shared in the forum. From a particular date, the company has changed the notice period for all confirmed employees, so the employees who are in service of the company are required to serve the new notice period. The employees who are about to be confirmed by default come under this new rule. However, for your personal understanding, you can approach the Human Resource Department.
