Hello all. My friend joined an MNC as a Java programmer. He was told that his working hours are from 10 am to 8 pm with a one-hour lunch break (total of 10 hours per day and it's 5 days a week). Also, his notice period is for 4 months. Could someone let me know if this is legal in India and what should be done in this case?

The spread-over in the MNC of your friend is 10 hours in a day, and working hours are nine hours in a day, which do not exceed forty-eight hours in a week, as you mentioned. The company is within the parameters of the law. I wish other members to contribute on law.

Notice Period Legality

Regarding your query on the notice period of 4 months: If the company has certified service orders with a provision of 4 months' notice for termination or resignation from the services, then only the notice period of 4 months is legal; otherwise, it is not.

You have not mentioned which state you are in, but as per the West Bengal (Kolkata) Shops & Establishment Act, the working hours in an establishment should be 8 and a half hours a day with a one-hour break. However, it should not exceed forty-eight hours a week with one day off. Having 5 working days a week is okay. You can also check this information on the internet.

As far as the Notice Period is concerned, it depends on the organization; it's the management's policy on retention.
