Hi everyone. I am Priya, working as an HR Executive in a manufacturing company. I have been working in this company for a year now. No policies are followed in this company. I came to know this after joining the company, but it was my first job, especially in HR, so I compromised myself. The company deducts PF and TDS from CTC but does not pay it in actual. We show these deductions in the payslip, but there is no proof for that like PF number, Form 16, etc. I was asked to hire people from the top companies in the same industry, and I was successful in that. I tried a lot to generate profits first and later convinced my boss to follow all policies. However, due to past mistakes made by the company, new joiners are getting negative feedback from the market, leading some of them to quit. Moreover, my employer is not willing to pay travelling expenses and salaries for salespeople until they show results. Our products are new, but the prices are almost equal to those of top brands. As a result, salespeople are unable to show immediate results in the first month. Despite my efforts to convince my boss, he is not willing to give more time and often asks me to terminate employees. Sales employees who have not even received their joining expenses (they come from other states) are hesitant to believe in the company and continue working after a month. In this situation, I do not see any growth for me in this company. Throughout this year, I have tried my best to set things up, but nothing has been successful as the ultimate decision lies with my boss. Now, I have decided to quit the company. I have not received my last two months' salary. I resigned two months ago and mentioned a three-month notice period, which my boss did not accept. If three more days pass and my resignation is not accepted, I should be entitled to three months' salary from the company. During this time, if I quit, will I be able to get my last three months' salary if I approach the labor office? How can I retrieve my PF and PLI (Performance Linked Incentive), which amounts to 10% of my CTC? Additionally, I am unsure how to approach a new job with this experience as I have not received my salary for the last two months due to the company's financial crisis. I am unable to provide my bank statement as proof of salary. I kindly request all seniors to suggest what steps I should take next. Waiting for your valuable replies.

Hi, please take your payslips. If they have mentioned PF deductions on your salary slip, please file an RTI with the EPFO office and ask them for details of your account. If you get the details, then you can go to the Regional Commissioner of the EPFO office. If your PF is not deducted and they simply showed it on the salary slip, then you can file a case against them.

Job Change Considerations

Regarding your job change, try some other companies. Companies will not consider your PF or ESI deductions; they only consider how knowledgeable and talented you are in your work.

Dear Seniors, I have already shown a lot of patience; that is how I survived here for one year. But now I completely feel negative about hiring people only to terminate them after one month. There is no use for my hard work. I am hiring sales professionals from top companies, but everything goes in vain after a month of their joining.

I have payslips prepared by myself, but I know there is no record of PF under my name, not only for me but for any employees in the company. Deductions for PF and TDS are shown in the payslip, and I know it's hard to get relieving certificates from my boss as he does not want me to resign since I am the only HR in the company.

I am the only one who has to deal with all employee queries where I do not have answers for their questions as the company is not following policies. My boss's stance is that we will pay only to those who do business (sales) in their territories. However, new employees argue that as ours is a new product with high prices, it takes some time, at least 2-3 months, to start the business. My boss is not ready to give them that time and salary.

In addition to their problems, my salary is also not paid on time. I am always trying to improve the situation, but in vain in the end. I have finally come to a decision to quit. However, my three months’ salary is due with the company. Here are my questions:

1. If I resign now, can I get my relieving letters, last three months' salary, and PF amount if I contact the labor office? If yes, what is the procedure?

2. Without a bank statement, will only a payslip, even if prepared by me, serve as proof of my salary?

3. If my future employer asks for the reason for leaving the company, can I tell the truth? If not, what can be said?

4. Is my decision to quit correct, or should I rethink it once? Because among all my MBA HR batch mates, I am the only one who got a job in HR. But in this company, I still don't understand if it's my luck or unluck.

Resignation and Relieving Letter

If I resign now, can I get my relieving letter, last 3 months' salary, and PF amount if I contact the labor office? If yes, what is the procedure?

Ans: If you resign, you will receive your relieving letter and 3 months' salary without fail.

Proof of Salary Without Bank Statement

Without a bank statement, only a payslip, that too prepared by me, will serve as proof of my salary?

Ans: Nowadays, recruiters often only require a payslip. For senior positions, they may prefer to see a bank account statement.
