I am working as an HR Assistant in a construction company. We have 27 drivers in the company, and the salary of the drivers is Rs. 6900/- per month. They do not want to contribute to the PF from their salary.

Form 11 Requirement

My question is, is it necessary to fill out Form 11? If all the drivers are new to their job, have no previous employer, and do not have a PF account, how should we fill out Form 11? Also, I would like to know if we need to submit this Form 11 to the PF department or if it is not required.

Please assist me as soon as possible.

Thank you and regards,
Deepak

Mr. Deepak,

Form 11 Requirement

Form 11 is compulsory whether the employee has a previous PF account or not. It is important to note that Form 11 will not be submitted to the PF department.

My staff members are freshers, and they have no previous employer or previous PF number. However, in Form 11, there is a column for the previous employer and previous PF number. I would like to know what to mention in those blanks. Please help.

I agree with your comment, but it's just a formality. According to the law, Form 11 is not compulsory to submit to the PF department. Form 11 will be attached to the employee's personal file with the signatures of the employer and employee. There is no need to submit Form 11 to the PF department.

Thanks & Regards,

Form No. 11 Requirement for Exempted Employees

It is compulsory to fill out Form No. 11 for all exempted employees who are not members of the scheme. If they have not joined any establishment in the past, it is mandatory to fill it out. Form No. 11 is basically a declaration by the employee about their past service, membership, etc. It is required to be completed by employees newly joining an establishment where the provisions of the EPF and MP Act are applicable. The form is kept by the employer to prove that the employee is exempted. According to the provisions of the Act, you do not need to submit Form No. 11 to the PF Department. Keep the form in the personal file of the employee.

Form No. 11: Declaration on EPF Subscription

Form 11 under the EPF scheme pertains to information provided by an employee when joining a new employer. It includes details about their previous employments, such as the names and addresses of employers, along with the duration of service. In this form, a new joiner also declares whether they were previously a member of the EPF scheme or not. This form is to be retained by the employer and not submitted to the Sub/Regional Commissioner. During inspections of an establishment, EPF inspectors may request these forms to verify eligibility criteria.

Please find the attached file.
