I want to ask about the legal heir certificate. My father passed away in January 2013, and he was a state government employee. I have applied for a legal heir certificate, but I have a doubt about whether I have to submit a single form for every purpose, i.e., for my father's gratuity, pension for my mother, EPF amount, or if I have to submit separately for each purpose. I need suggestions as soon as possible. This inquiry pertains to Odisha (formerly Orissa).

I don't know what the procedure is for government employees. However, for private employees, every employer is required to obtain a nomination certificate for the payment of gratuity and other legal dues payable to employees in a prescribed format as per the Payment of Gratuity Act and PF nomination form for PF. If an employee passes away, the company pays the dues to their legal heir based on the certificate issued by the local Panchayat/Municipality, as applicable. The concerned authority issues only one copy of the certificate, but a true copy can be used for multiple purposes/applications. Simultaneously, this certificate can be used for obtaining PF contributions, family pension, and EDLI benefits.
