I am working as an HR executive at a private IT firm in Kerala with an employee strength of 40. I need some clarifications regarding the provision of clubbing leaves. For example, if Friday is a holiday and the following Saturday is a working day, and of course, as normal, the Sunday after it is a usual holiday as in all companies. So in such an instance, there is a practice found among my employees to take a day off on Saturday so that they get 3 days of consecutive leave.

Seeking Legal Guidance on Clubbing Leaves

I would like to know if there are any laws in India to discourage such clubbed leaves. Or could you suggest a good leave policy to discourage this practice which would not have any legal contradictions? One policy we had in mind was to deduct salary for 2 days, taking into account the leave for Saturday and a loss of pay for Sunday, even though Sunday is a weekend holiday. Is there any law in India that restricts my organization from implementing this policy?

Kindly get back to me on this issue as soon as possible.

Clubbing leaves is based on organizational policy and is not related to labor law. When framing a leave policy, we have to consider whether to club PL/CL as a prefix or suffix. You can also reframe the leave policy and announce that. Deducting salary abruptly from an employee for taking leaves on weekends is considered unethical and unprofessional.

Leave Planning

First of all, have a leave planner circulated to all employees, asking them to plan their leaves for one calendar year/fiscal year. Only "Sick Leaves" are allowed to be taken with detailed information. It is crucial how you communicate the policy. Good luck!
