Friends, I quit Convergys India Services Pvt Ltd some time back and submitted my completed Form 19 & Form 10C in order to withdraw my EPF & EPS contributions. I submitted my forms on the 6th of September 2012 at their Bangalore office, and I regularly check the EPF site for the claim status.
I thought that the company hadn't submitted the forms yet to the EPF Office in Gurgaon as the site always said there were no records of the claim. To confirm this, I raised a grievance with the EPFO, and they confirmed that the company hadn't submitted the forms.
I called the HR Direct line of Convergys, requesting an update and was astonished to hear them tell me that it would take at least 3 months for the forms to be submitted to the EPFO. This is completely absurd and makes me think, is there anything that I can do to hasten the process, and is there a particular timeframe that the company needs to submit the forms?
I am contemplating legal action against my previous employer, and I guess RTI wouldn't work in this regard as it's a Pvt Ltd. Please advise!
Additionally, how can I pursue submitting my forms myself with a bank manager's or a gazetted officer's attestation as the PF form requires "Contribution for the Current Financial Year" to be filled, and I do not have this information as the company stopped giving the PF account balance slips about 4 years back!

Normal Waiting Period for Claim Submission
The normal waiting period to submit the claim form is 60 days from the date of your resignation. The processing time for the claim is up to 40 days. You have to wait for 90 to 100 days after submitting your resignation.

You can submit the application only after 2 months from the last day of working, and you can give some reasonable time to your HR for processing the application. Then, after the reasonable time period, please approach your HR Department. They will give you the dispatch details and acknowledgment for submission of your claim form. From the date of acknowledgment, you can wait for a further 15 days and check the portal to get the details. If you mentioned your mobile number on the top of Form 19 & Form 10C, then you will get the SMS alert also for the processing and deposit in your bank account.

Thank you for the reply, Imok. I understand that there is a lot of backend work that goes into submitting a PF form. My question is, is there a maximum timeframe that an employer can take to submit the EPF forms to the EPFO? Is there any clause or guideline that specifies the number of days an employer can take to submit the forms? Similar to how the EPFO can take a maximum of 30 days to process the file and release the contribution.

There is a time frame for the employer to start the process. The employer can only initiate the process after 2 months from the date of non-employment (your Date of Relieving from the company). Then the PF office will take a minimum period of 45 days to complete the process.
