Our plant is located in a notified area under the ESIC Act in North India. Another plant is situated in a non-notified area in the Pune district. Some employees from the plant in North India have been permanently transferred to Pune, which is in a non-notified area. The wages for these employees are processed by their original plant. Can our plant in North India deduct the ESIC contribution? If yes, can these employees avail themselves of the ESIC facility in Pune?

If the employees has god the ESI identity card then they can avail the benefits of ESI where ever in india.

What I understood from your posting is that some of your employees have been permanently transferred from a unit covered under ESI to a unit in a non-implemented area, and therefore, the latter unit is not covered under ESI. The salary of these transferred employees is currently being administered from the ESI-covered unit. Your question is whether these transferred employees should continue to be under ESI or not.

My answer to this is - NOT.
