Dear Cite HR Members,

I worked in a bank for 21 days, then I left the job as I am suffering from cysts that have appeared on my neck. After 12 days, I sent my resignation to the branch manager as I cannot continue my job. However, after receiving the resignation letter, my bank manager informed me that they would not provide any release letter and would issue an absconding letter against me, which may prevent me from securing a job in the banking industry.

Kindly advise me if this action is possible or if they can indeed proceed as mentioned above.

Yes, they can do that. For 21 days, no one will give you a relieving letter. Indeed, you have absconded and later decided to resign after 12 days of having absconded.

Further to what Sanjeev Himachali clarified, what you mentioned doesn't really jell. If the reason you mentioned, 'cysts which have appeared on my neck,' is indeed true, you should have gone on medical leave—or at least submitted a doctor's certificate. No one resigns for the reason you mentioned—it only hints at some sinister or unsaid cause behind your action. Perhaps your bank also had the same 'reading' when they took the actions they did.

Impact of Leaving Without Notice

Leaving without giving the notice period would surely affect the companies, whether banking or any other for that matter. Secondly, it's not the right thing to do to join jobs you are not interested in. Anyways, you may at any time quit the job; it is your choice, but you cannot leave abruptly. The procedure you have followed is incorrect and not accepted. If you are not interested, you must first serve them the notice period as per the employment agreement, and then you shall give reasons for resigning. Even during medical emergencies, the employee will be on leave, but he cannot leave the job without informing the employer.

Steps to Resolve the Situation

You may leave the job and demand the relieving letter after the completion of the notice period and observing any other formalities as per the employment contract. The employer may not provide you a relieving letter, but since you have contacted the employer and given the reasons for the same, you may temporarily avoid the absconding issue.

So, go to your manager, provide copies of all your medical certificates, and state valid reasons like cysts causing you attention problems. Explain that you are very conscious about it and cannot freely concentrate on the work, and it has an impact on your psychology. You may mention if you have any physical issues that hinder your working capability. Then, serve your manager a notice with a resignation formally and complete the work assigned to you. It will follow its path later in the right way.
