Hi seniors, I want your urgent help.

Background of the Incident

I joined the BPO industry on 2nd Jan 2012. On 7th Jan 2012, while coming to the office, I met with an accident just 200 meters away from my office. I was treated at Fortis Hospital, where I also registered an FIR.

Working from Home

I started working from home as, at that time, X-rays were clear, indicating no bone injury. I have completed all tasks assigned by my seniors from home (I have all emails on record). After three weeks, once I was done with the MRI, I discovered a ligament injury, and doctors suggested immediate surgery.

Surgery and Return to Office

On 1st Feb 2012, I underwent surgery, and on 29th Feb, I finally rejoined my office. The company has paid me half salary for working from home, which I don't have any issue with. Doctors suggested I take rest, but due to work pressure, I resumed my job.

Current Situation

Now suddenly, I got to know that the company is seeking my replacement, even though they have established all processes and policies through me. They are creating mental pressure on me so that I resign from my job, as they don't have any work-related reason to fire me.

Seeking Advice

Help me: if they terminate me or pressure me to resign, can I go to the labor court and file a case against them? Please help.

Regards,
Manisha Singh

It depends on what is mentioned in your appointment letter. As you are in the probationary period, the company might take advantage of that to replace you. It all depends on the situation where you currently live.
