We are an integrated steel plant employing operators. Is it mandatory for them to have licenses or certificates? If so, from whom must they obtain these? If any accident occurs on the company premises, what type of legal problems will we face if these operators don't have the necessary licenses?

It is mandatory to have the license since these cranes/forklifts require special skills to be operated, and if used incorrectly, they can cause significant damage as well as harm to the working employees.

Current Practices in Manufacturing Companies

Today, in many manufacturing companies, the crane and forklift operators are mostly provided by third parties or contractors. Due to a shortage of manpower, contractors sometimes hire individuals without a license and provide training, but they instruct the drivers to obtain the license promptly.

Accident Protocols and Responsibilities

However, in case of any accidents, the employees are covered under ESI, and an investigation will be conducted by the company. If a fatality occurs, the principal employer is responsible for compensating the employee's family, and the costs may be recovered from the contractors.

It is the responsibility of the Contract Cell/HR, contractors, and principal employers to ensure that only valid license holders drive the vehicles.
