What is the maximum number of days for accumulation of earned leaves under the Delhi Shops and Establishment Act?
As per the Central Government Service Rules, earned leave can be accumulated for a maximum of 300 days; anything above that limit is considered lapsed.

If a company gives earned leaves of 15 days per month, then as per the Delhi Shops and Establishment Act, leaves can accumulate up to 45 days at one time. What treatment will be done for leaves beyond 45 days? To what extent will leaves accumulate?

According to my understanding of section 22 and subsection 1A, the company can hold 45 days of PL for an employee, and any accumulation of leaves beyond 45 days can be encashed by the employee on a year-to-year basis or otherwise. Am I correct?

Please clarify what is the limit of earned leaves that can be availed by an employee in one stretch. If a company is providing 2.5 earned leaves per month, how many days does an employee have to work to be eligible to take these leaves? Also, will the employee be eligible for earning leaves for the month in which they are on leave?

Dear Priyanka,
Please refer to section 10 under the UP Shops and Establishments Act. An employee can accumulate earned leave up to 45 days. For watchmen and caretakers, this limit is extended to 60 days. The wages for the unavailed portion of earned leave should be paid when the service is terminated.
