Do you have any sample format of a legal notice to be sent to an ex-employee who has breached the agreement they entered into at the time of joining the company? The agreement stated that the ex-employee would not join any competitor company within 6 months of the expiry of the term of the agreement, and also forbade the disclosure of confidential information to competitors.

Hello Nihar,
I suggest contacting your company lawyer since responses to every such situation will be different, depending on the case-to-case factors and nuances. Any generalized sample format could only mislead or complicate the long-term response for you.

Well, I agree with Mr. Tajsateesh. Mr. Nihar, first of all, I would like to say that you have to take action as per the contract terms, and I don't believe that your HR department has never encountered this kind of case before. Are you the new cog in your department or part of HR? Are you an employee trying to understand the legal implications in this regard, or are you a new member of your department assigned to this job? Mr. Nihar, this is a case that should be handled by HR seniors or the people as suggested by TS above.

Thank you all for the replies. I just wanted to ask if anybody has ever dealt with a situation similar to the one I mentioned above and has drafted a letter regarding it. If so, kindly provide the same.
I am a new employee in my organization's legal department, and my senior has asked me to draft this letter. I have almost completed it, but I would like to see how others would handle it and what are the essential points that should be included when sending legal notices to former employees.

Hello Nihar,
First and foremost, you should have given the full inputs in your first post - that you belong to the legal fraternity, in addition to the facts of the case. CiteHR being a predominantly HR forum, the de facto assumption would be made that you too are an HR professional. I suggest using the search option at the top of this screen - this topic has been discussed many times earlier. You should be able to find what you are looking for.
