As you rightly said, the tenure of renewal is 5 years. Please go through the below as per Maharashtra Factories Rules:

Provided further that no manufacturing process shall be carried out in any premises of a factory unless a fresh certificate of stability in Form 1-A is obtained from a competent person once in each period of 5 years or after extension, alteration, repairs, or addition of any work of engineering construction or replacement or addition of machinery, plant, etc., and sent to the Chief Inspector.

For building, we are obtaining stability certificates. I would like to know if there are any norms defined for stability certificates for Palletisation Racking systems (MS Storage racks) used to store finished goods manufactured in the manufacturing unit.

We started our second unit at Thanjavur in the year 2009. I need to know whether we need to get a stability certificate immediately or if we can get the certificate after the completion of two years. Please reply.

Thanks & Regards,

Hi Lalitha J,

Just go through the clause from the factories rules:

No manufacturing process shall be carried out in any building or part of a building, whether newly constructed, reconstructed, or extended, or in any building that has been taken into use as a factory or part of a factory, until a certificate of stability in respect thereof, in Form "___" signed by a competent person, has been submitted by the occupier or manager of the factory to the Chief Inspector and accepted by him. Additionally, no new plant or machinery shall be added to any building of a factory or brought into use after such addition until a certificate of stability in Form "____" signed by a competent person, in respect thereof, has been submitted by the occupier or manager of the factory to the Chief Inspector and accepted by him.

So, you must obtain the stability certificate before commencing the manufacturing process.

Thank you for your valuable information. According to the Factories Act of 1948, Section 40 on the safety of buildings and machinery, and Section 40A on the maintenance of buildings, the tenure of the stability certificate is not mentioned as you stated for 3 years. Can you please clarify where the tenure of three years is specified in the Factories Act?
