Starting a Consultancy: Legal Procedures and Requirements

This is Simran, residing in Pune. I am willing to open my consultancy, which will provide services in placement, real estate, and insurance. Can you help me out with the legal procedures to start the consultancy? Where do I need to register, and what are the documents required? Do I need to obtain any licenses for providing the services I mentioned? If yes, what are the documents required for getting a license, and where can I obtain it?

Please assist me as soon as possible.

To start your own consultancy, you need to obtain a Shop Act license, PAN number, and service tax number. Where do you plan to start in Pune? I can assist you with the other operational aspects as well. All the best for your new venture.

Dear Simran,

Congratulations on setting up your own business. It all depends on your investment, how much you are willing to invest for the consultancy setup.

Initial Legal Requirements

As for the initial legal requirements, you have to form a Society under the Societies Act. You need to show around 7 members to the society registrar to demonstrate your team and designate a few positions as well. It's all about formalities; you may add your team members or family members for the same. After getting enrolled in society registration, you can start your consultancy business. You will start working as a registered firm under the Society Act, and later on, if you wish, you can also get a Service Tax number for your firm and convert your firm into a Private Limited company.

Business Operations and Agreements

Rest assured, you have to make tie-ups with employers with proper agreements on services offered, charges required by you, and the replacement system of candidates, etc.

Registration and Fees

Initially, you have to go for registration under society/Trust/N.G.O. The nominal fee is around 5,000 maximum they would charge for it. You must have a rented/owned place, a PAN card should be available, and later on, you may apply for your firm's PAN number for better authenticity.

You may email me if you have any other queries.

Regards,

Manish Srivastava
