Hi, Please go through the below mention circumstances and reply me with ur suggestions:
Recently i have resigned from a company (Recruitment Firm) without providing notice period to them and i have written in the resignation too the same thing but they did not accept my resignation. As in the Offer letter which i got, there was only mention that if i want to leave from their employment i have to give 60 days notice during Probation. i was in Probation but i resigned without giving notice.
They did not mention anywhere in offer letter that if i wont serve notice period then i have to pay compensation against it.
Now they are asking for compensation of notice period, but they have not written any where in offer letter, nor it is there in their policy.
The day when i left i told them clearly that i wont come from the next day and they said ok.. On my last day also they did not say anything for notice and compensation.
I have already given them a replacement for my position and they have hired another employee as well.
Now plz suggest when an employer has not written anything in offer letter, is it a valid thing for which they are asking (Compensation).

Dear chandni ,
if there is no clause in your offer or appointment letter about the notice period salary, then no one can ask you the same. Please go thru the clause of termination in ur appointment letter properly or put the content of ur appointment letter here so that proper decision can be taken.

They have not mentioned any heading or sub heading stating the tremination clauses / terms and conditions as such. They only mentioned as:
Timings and Related Expectation:
> Your employment is intended to be long-term and indefinite, subject to conditions specifies ahead, if any.
> you shall be on probation for 3 months.
> During the probation of period:
- The company is entitled to relieve you, when governed by genuine and strong reasons, at 7 days' notice and at 21 days' notice on any reasonable grounds.
- You are required to give 60 days' notice should you wish to leave our employment.
> After the Probation period:
- The company is entitled to relieve you at 30 days' notice.
- You are required to give a notice of clear 30 working days or 45 days, whichever is higher.
- you shall enjoy extra benefits as enumerated ahead.
- Working days are Monday to Saturday as per the following timings, which is subject to change from time to time.
- Monday to Friday : 9.30 am to 6.30 pm
- Saturday : 9.30 am to 3.30 pm
- Adherence to the above/ Prevalent timings is essential.
- All leaves should be applied for in advance to the maximum extent possible.
Attn: Above mentioned details mainly they wrote in my offer letter, other than these they have not written any thing for compensation and notice period.
In remuneration part also they only wrote about my gross salary, nothing as for compensation and notice period.
Plz suggest me according to their terms is it a valid thing for asking compensation against notice period , even though it was not a bond or contract.
Plz revert ASAP..

Hey chandni,
in the case u are not supposed to pay any compensation as ur notice pay, they can ask u 2 work for 2 months as per the letter statement but cant force u 4 compensation as u have already given dem ur replacement.
Do let me know that is there anything due on their side, have u taken ur full n final from them.

I have not received my 13 days sal. from them which i served, earlier when i dint left they were saying abt my sal. that usually they pay if notice period has not been served but when i finally left that company then they are asking to me for compensation.

I go through your offer letter and terms and condation there is no cluse of compensation therefor u need not to pay ccompensation they are trying to make pressure on you. They cant force you for compensation as u have already given them your replacement.

Is this firm with which u worked is a renowned place or some small company. If its small place then i hope they dont follow the practice of giving relieving letter.
At any cost u r not liable 2 pay them.

Yes that was very small firm and i was not happy there. i was totally alone who were working for them as it was new branch in bangalore but they have their HO in Ahmedabad, staffing is there. I asked them to increase the staffing for Bangalore branch but they dint increase as i was handling the entire work individually and they were getting profit from my work. it is a consultancy and i gave them good clients and placed candidates so they earned profit from their client so they were not planning to hire immediately.
But its been two months , I have been asking them alternatively for new hirings but they dint hire anyone and alone its very difficult to work, my manager used to visit daily but for some time and then i had to sit alone for entire day and work at my own.
Jz think over the situation and let me know how would be the work place according to you?
