Query on PF Withdrawal Without Employer's Signature

Please resolve my query: If anybody leaves the organization and their previous employer is not willing to sign their PF withdrawal form, what should they do to withdraw the PF amount? How can they withdraw their PF without the previous employer's signature?

If an individual has left the organization and the previous employer is unwilling to sign the PF withdrawal form, what steps should be taken to withdraw the PF amount? How can the individual withdraw their PF without the previous employer's signature?

You can get the forms approved by any gazetted officer. All forms are available at the EPF site or any stationery shop. However, your previous employer cannot stop you from claiming the PF amount. Why can't you claim from your previous employer?

First of all, the employer has nothing to do with the PF amount; it is in your account. The employer's involvement is in confirming "leaving job." You should be out of the job for 90 continual days to claim PF.

If your previous employer is not supporting you in this, I recommend the following:

1. Show the PF officer that you are out of the job. You can demonstrate that your PF account has been inactive since the date of relieving.
2. The PF authority will send a legal notice to your ex-employer regarding this.
3. Approach a lawyer for the same.
