I joined a company on 01 July 2010. I received my salary for July. I quit the company on 30 Aug 2010. I also decided to forgo my one-month salary due to me for the month of August in lieu of my notice period of one month. Therefore, I have not received my salary for August 2010. Now my employer wants me to remit back the salary which was given to me in the month of July, also in addition to the salary I have foregone in August. My notice period in the company as per terms of the agreement is one month. Is my employer right in asking me to remit my salary for the month of July as well for which I have worked.

Hi Rahul,

May I know the reason why you quit the job? You have only worked there for 2 months. What is the mandatory working period for your old company? They have invested their time and other resources in your induction process because they want to receive services from you. As you left the company for a short period, they may want to recover the loss, which might be why they are asking for your last month's salary as well.

In this situation, they have the right to ask you to return the salary they paid you.

Thank you for your inputs. There is no mention of a mandatory working period in my offer letter. The notice period stated in the offer letter is one month.

Dear Rahul,

It is not proper to leave the job abruptly and request the company to consider that as your notice period. First, have you submitted your resignation letter and informed them about your intention to leave the job? If not, then you should approach the HR department. Talk to them and explain the reasons why you are quitting. This approach will help in resolving the issue. So, go ahead and have a discussion with them.

I agree, it's also not going to look good on your resume if you quit a job in two months without a very good reason. If you delete it from your resume, it shows a gap which is another red flag.

Really think about why you want to leave, try to resolve whatever the issue is, and stay with the company if you can.
