I am Subodh Mudgal, working in a manufacturing company. I have to send the annual return under the Factory Act, 1948. Please guide me on the following topics:

Leave with Wages

1. Total number of workers employed during the year

Problem: Should I have to give the number of employees working at present with us or the total number of employees including joined and left? Please provide me with an example.

2. Number of workers who were granted leave during the year

Problem: Should I mention the employees who have left as well?

Shelters of Rest Rooms and Lunch Rooms

Are there adequate and suitable shelters or rest rooms provided in the factory as required under section 47?

Problem: In the Factory Act, it has been mentioned that where more than 150 workers are ordinarily employed, a rest room should be provided. Should I count only workers or the staff employees as well?

Accidents

Total number of accidents

Problem: Should I mention the death case of the employee who was covered under the ESIC Act?

Form III

Annual return under the Minimum Wages Act, 1948

Total wages

Paid in cash

Cash value of wages paid in kind

Problem: I do not know how to calculate the cash value as mentioned in the form but still in confusion. Please provide an example.

Form IV

Annual return under the Payment of Wages Act, 1936

Gross amount paid as remuneration including deductions under section 7(2) of which the amount due to profit-sharing bonus is...

Money value of concession

Problem: Please explain the money value of concession with an example.

Please see the total wages paid including all the points written above in Form No. 21.

Dear, it is not so easy to submit the return; you have to know the basic acts first:

Steps to Submit the Return

1. First, check your factory registration certificate and note the number of workers registered by your factory.
- Total attendance of employees during the year divided by the number of working days should be equal to the number of workers. Please check that it does not exceed your licensed manpower.

2. All employees should fall under the category of granted leave; you cannot allow any person to take leave outside this category.

3. This includes all the workers if you calculate according to the formula above.

4. Dear, compliance should always be completed according to the act; you cannot violate them. First, read all the rules related to these formalities, and then fill out the annual return.
