Hello,

I have a query about the provision of creches under the Factory Act and Bombay Shop and Establishment Act. How many female employees are required to comply with the above provision? In which type of factory and office is it necessary?

In general, we have not seen this provision. Moreover, to be on the safer side, you may go through the applicable State Shops & Establishment Act regarding the applicability of this facility.

Let me modify my query: Is a crèche a requirement for the IT industry and BPO where a substantial number of women are employed? Also, how can one comply with Section 11 (on Nursing) of the Maternity Act in case a crèche is not available near the worksite?

Hi,
Creche facility requires every establishment with 50 or more employees to provide
crèche facilities within a prescribed distance. The woman will be
allowed four visits to the crèche in a day. This will include her
interval for rest.
