Hi, I have a query about PF withdrawal - Is it possiable that if employer is not ready to release Pf of any employee , Can that employee submit his PF Claim form as his own? Regards,

If the employer is not willing to sign your PF claim form, you can still claim it by furnishing all details along with a copy of your bank account. It is mandatory now to claim PF. Leave the authorized signatory section blank and enclose a covering letter stating, "The employer isn't willing to sign the claim form." Do not take a gazetted signatory on your form; this should only happen when the establishment is closed.

Even I don’t understand.. As far as I know, PF account is on the name of employee only not on the name of company.. I think he can claim for PF.

Hi, You can withdraw EPF accumulation without the signature of your employer. Just fill up the form, sign it, and get the counter signature of your bank manager for verification of the signature. Submit it at your RPF office along with a covering letter addressing the Regional Provident Fund Commissioner. In the letter, mention the non-cooperative attitude of your employer.

Process for Claiming PF Without Employer Signature

If you want to claim your PF, as per the provision, you need to have the employer's signature to proceed. However, if that is not possible, you can fill out the form with all the necessary details, leaving the employer's signature blank. Submit the form along with a covering letter, as I mentioned earlier, stating the actual reason for the absence of the employer's signature. It's up to you to decide how to explain this.

Don't forget to take an acknowledgment of the covering letter. Prepare two copies: one to enclose with the submission and another for your records as acknowledgment. Then, the PF authority will send an inspector to verify and sign the claim form, which is the actual process.
