Dear All,

One of my friends had applied to the Gurgaon PF department to settle his pending dues from the last year. The respective forms were signed by the bank manager. However, he could not obtain the signature of his employer due to some unavoidable reasons as his account with the employer is yet to be cleared. The amount of PF dues is substantial, totaling Rs. 800,000. The PF department has rejected his forms twice after informing him over the phone that he must get them signed by the employer. He is currently residing far from Gurgaon and is unable to follow up in person.

Kindly advise on the course of action.

Dear Ramesh,

You can take either or all of the following steps:

First of all, please inform us if you are currently employed. If you are employed, you cannot/should not apply for final settlement. Are you sure your employer remitted all your PF to your PF account? (If your employer is exempted, your PF account shall be maintained by your employer's PF Trust themselves.) Subject to this, my suggestions are:

1. Send a registered letter with acknowledgment due, attaching the final settlement forms which can be downloaded from the websites, and forward a copy to your Regional PF Commissioner.

2. After 15 days, send a reminder, with a copy to the RPFC, asking them to inform you of the action taken.

3. If you know your PF Account No., check the position "online" through the PF website.

4. After a month, if there is no progress, send a legal notice directing them to hasten the settlement or transfer, as the case may be, within 15 days.

5. If nothing is happening, file a complaint with the Grievances cell of the RPFC.

6. File a suit with the appropriate Consumer Forum for the settlement/transfer of your PF.

On the right of your screen, you will find earlier postings and links for similar problems. Use them as your guidelines.

PF amount cannot be adjusted against any dues whatsoever under any circumstances.
