I had given resignation from one of the pvt. ltd comany on december 2009.with notice period of Month taken clearance from them after them in the month of january 2010 i have joined to the competitor company.now company is not clearing my dues.
i would like to know how i can get my dues...

I had given resignation from one of the pvt. ltd comany on december 2009.with notice period of Month & taken clearance from them after that in the month of january 2010 i have joined to the competitor company.now company is not clearing my dues & saying that i have signed a bond i.e i can't join any competitor but as per the the bond validity was for two year which has been covered by me.
SO I would request you to all pls. let me know is there any problem to getting my dues or any legel action can be taken against me.

Hi,
Would request you to go through the contents of the bond if you have a copy. Kindly see if the clause mentions that you can not join a competitors company withing two years from leaving the services of the first company.
If the clause is so, then the company may be taking a shelter under that.
However such bonds are not tenable in law unless the previous company has spent money on training you abroad for attaining certain skills.
Other wise these bonds do not have any validity.
You may kindly issue a simple legal notice for immediate settlement ofyour dues through a lawyer.
Based on the same you may further initiate legal proceedings as well.

Hi Dayanand jee.
As per the bond i can't joint the competitor within 3 months after the tenure period two years of the bond.it's mentiond separatly in non-competet & disclosure document.I got normal training by the seniors at posted office & there wasn't any extra cost involve in this. Pls. Suggest on this.
