Dear Seniors,

Please help me out, as I am a bit confused. During an interview, I was asked about the difference between a Charge Sheet and a Show Cause Notice. Kindly inform me about the main differences between them. Also, could you clarify which one is issued earlier, and in what circumstances a show cause notice is appropriate compared to a charge sheet?

Hi Rajesh,

Once you receive information that a particular group of employees is involved in any indiscipline activity, then framing all the charges under the model or certified standing orders applicable to the organization, the charge sheet will be issued, asking the individual employee to submit his explanation within 48 hours, 2 days, 3 days, etc. Therefore, the process starts with the charge sheet.

If the management is not satisfied with the employee's explanation, then they can call for a domestic inquiry. Once the inquiry is completed and the inquiry officer submits his findings to the management, the management will issue a show-cause notice to the employee, mentioning the proposed punishment. Even if it is a major or capital punishment, the management will issue a second show-cause notice, providing more opportunity to the employee. Hence, all put together, the charge sheet is the beginning, followed by a show-cause notice only if required.

Clarification on Show-Cause Notice and Charge Sheet

Please let me confirm, between a show-cause notice and a charge sheet, which one is the first priority to serve against the delinquent employee and what is the common difference between a show-cause notice and a charge sheet.

Namaskar to all of you. I am a very new member of this forum. My doubt regarding the difference between the charge sheet and show cause has not yet been cleared. Which one is to be issued first? Should I issue a charge sheet before issuing a show-cause notice where there is sufficient evidence against an employee? So far, I know a show-cause notice is issued first, then the charge sheet, and then, if necessary, the management will start a departmental enquiry. Is it correct? I want to know the details of it.

Suspension can be based on prima facie evidence. However, if the reasons for suspension turn out to be insufficient, the suspension shall be revoked with all applicable benefits due to the employees. I think that even during the suspension period, the employee is eligible for a certain portion of his salary/wages.

Understanding the Difference Between a Show Cause Notice and a Charge Sheet

There is essentially no difference between a Show Cause Notice and a Charge Sheet. Both documents contain statements of allegations, the consequent acts of misconduct committed by the employee, and direct the employee to submit a written explanation within a stipulated timeline, showing cause why disciplinary action should not be taken against them for the alleged acts of misconduct.

People generally refer to the document as a show cause notice if it pertains to a minor act of misconduct and a charge sheet if it pertains to major misconduct. However, the format of the two documents is the same, including the statement of allegations, the consequent acts of misconduct committed, and the requirement for the employee to submit a written explanation within a stipulated timeline.

Some organizations first issue a show cause notice, receive a reply from the employee, and then issue a charge sheet, although the contents of the two documents are much the same. This process can delay proceedings, as the employee's reply to the charge sheet must again be obtained before proceeding further.

The Second Show Cause Notice

The show cause notice issued by the disciplinary authority after the conclusion of a domestic inquiry and receipt of the report of the inquiry officer is called a second show cause notice. In this notice, the delinquent employee is directed to show cause why they should not be dismissed as a measure of punishment for acts of misconduct proved against them in the course of the inquiry, as per the report of the inquiry officer. The second show cause notice is issued only if the organization proposes to impose the punishment of dismissal against the employee.

Types of Suspensions

Suspensions are of two kinds: Suspension Pending Inquiry and Suspension as a Measure of Punishment. Suspension of an employee pending inquiry can be resorted to before the issue of a charge sheet, along with the charge sheet, or even after receiving their reply to the charge sheet, based on the reply and depending on the gravity of the misconduct allegedly committed by them. Normally, suspension pending inquiry is effected either before the issue of the charge sheet or along with the charge sheet. Suspension as a measure of punishment is imposed after following the disciplinary process, provided it is listed as a punishment in the Certified Standing Orders of the establishment. If the establishment does not have its certified standing orders, then it must be listed as a punishment in the Model Standing Orders applicable to the establishment.

As per your concerns, a charge sheet is issued for a major act of misconduct, and a show cause notice is for a minor act of misconduct. In the first show cause notice, if the employee gives a satisfactory answer, then their case will be stopped; otherwise, a second show cause notice will be issued for the employer's response and the type of punishment. If the employee has already written an explanation, it indicates that he/she will admit to their misconduct and accept the punishment, or decide to go to court. Essentially, the second show cause notice is issued for the punishment provided by the company with a written reason.

Dismissal of an Employee

Dismissal of an employee may be possible in both instances (charge sheet and show cause letter).

3. What is the difference between a charge sheet issued by the police to accuse a person of illegal/criminal activity in society/village/city, and one issued by a company to an employee?
