Facing Termination for Not Having a B.Tech: How Should I Handle This Unfair Situation?

Hi, I joined an MNC company two months ago on a third-party payroll for a 6-month contract basis. Initially, the third party provided detailed requirements, and I shared all the necessary documents. I began working after that. However, they have recently informed me that I will be terminated because I do not hold a B.Tech degree; I only have a diploma. According to company policies, they do not allow candidates with only a diploma. Therefore, they are requesting me to resign and serve the notice period to give me time to find a new job.

My concern

My concern is that I did not provide any false information or documents regarding my educational qualifications. I provided them with all the information they requested. It is perplexing that after working for over two months, this issue has suddenly arisen. I am unsure of what steps to take since I have not committed any wrongdoing. On one hand, I have been honest throughout, and on the other hand, they are urging me to resign or face termination at any moment due to my lack of qualification as per their policy. I would appreciate any advice you could offer.

First of all, you are already on a contractual basis, and your employment can be terminated at any time during this contract or upon completion of the contract. You can raise a request to retain your job if you are performing well; however, they may change your designation. I suggest starting to search for another job in your area.

Employment on Third-Party Payroll

Employment on third-party payroll will not and cannot be guaranteed by the Principal Employer. Now, as you have received communication regarding the termination of your services or resignation from service, the only way out is to request your contract employer to allow you to work for at least 2-3 months more. If you are successful in this, you may continue your work while simultaneously looking for a job elsewhere.

When the vacancy was declared in the recruitment ad or the classifieds, what qualification was asked for to fill the vacancy? Was it B.Tech or a Diploma?

Whether directly employed or employed through a manpower contractor, the recruitment department is expected to properly scrutinize the CV of the candidate. Discovering the qualification of the candidate after recruitment is a direct failure of those involved in the recruitment.

Like other learned members, I too recommend putting up an application for buying time from the employer. However, address your application to the Managing Director (MD) of the company. In fact, you may seek a personal interview to redress your grievance.

Lessons for HR Department

The contract employees are not the children of the lesser god. They too have to look after their family as much as the directly employed. Belittling their stature is against the principles of HR Management. A few employees are employed under contract employment for the convenience of the organization and not for the whims and fancies of the HR Department. The HR Department should have stood firmly behind the employee. Telling the employee to resign from work to cover up the failure of HR is the height of double standards.

Even with the recruitment of the wrong candidate, the sky would not fall if the company waited for six months to complete the contract period. For their own fault, the company wishes to penalize the employee! This is the height of preposterousness!

There was no ad for the recruitment. I got a call from the consultant company first. They said they got my profile from naukri.com. They conducted a telephonic interview, and I mentioned that I have a diploma, not a BTech. However, they indicated that it was fine. Later, I received another call from the line manager of the main company for a technical interview. Following that, I received a confirmation email stating that I had been selected for the position and was asked to provide all the necessary documents via email for the offer letter generation. I received the offer letter and submitted the requested documents.

After a month and a half, I received the appointment letter. Nowhere did they request my degree documents or mention that I was ineligible. This issue arose suddenly.

I have replied to your post. It is purely a failure of the HR Department. Probably, they were not able to find a suitable candidate. As a temporary measure, they brought you on board. Now that they have found a candidate, they may be asking you to resign. The company simply used your candidacy as a sacrificial lamb.

Recruiters or HR professionals sometimes play these kinds of tricks. Anyway, as advised in the previous post, submit an application to continue your employment until the completion of the contract period. Employers always have the upper hand. Therefore, despite the injustice done to you, remain polite and composed. At this stage, simply appeal to the relevant authorities.
