Supreme Court's PF Order: How Are Establishments Handling Past Allowance Notices?

Friends, we are aware that the Supreme Court passed an important order on 28.2.2019 regarding the applicability of PF on various allowances. The review petition filed against the order has since been dismissed. In the meantime, the Department has started issuing notices to establishments asking for data for the past period to check compliance. EPFO has now issued a circular dated 28.8.2019 (copy attached) to its offices not to take any action on such notices unless some information is available about illegal practices being followed by them and not to make roving inquiries. This is just for your information.

Dear Sir,

Thank you for providing us with the latest circular. In the write-up, you mentioned that "Review petition filed against the order has since been dismissed," while according to the EPFO circular dated 28.02.2019, it states, "It is further informed that a review petition has been filed by some aggrieved parties before the Hon'ble Supreme Court and is pending for adjudication." Please clarify.
