Sexual Harassment Committee in Small Software Firms: Is It Mandatory and Must It Be Vishakha?

PratibhaShyam
Below are the two questions for a software company with an employee strength of 100:

1. Is the formation of a sexual harassment committee statutory?
2. If yes, should it be the Vishakha committee only?

Thank you.

Avika ji has provided you with the answer. The role of the Vishakha Committee has been assumed by the ICC under the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013. Please refer to the link below to learn more about the Act and the ICC.

Even if your organization has female security guards, sweepers, or visitors, you still need to have an Internal Complaints Committee (ICC). If establishing an ICC is not feasible, you can utilize the services of a Local Complaints Committee (LCC) that may be available in your area or district.

What if a company has only 11 employees, out of which two are women working for 5+ years and another two just recently joined? Do they still have to form a committee? Also, clarify how to involve NGO's members.

Thanks and regards,
JD
