Seeking Guidance on Submitting Sexual Harassment Reports to District Authorities: Any Tips?

Hi Seniors, has anyone, to date, submitted the document/report to the District Authority as prescribed in the 'Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act 2013'? If yes, could you please guide me with a format for submitting the report? What are the other documents required?

According to Section 1(3) of the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013, this Act shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. We have not yet come across any such date for its applicability. Appropriate Governments are yet to notify the 'District Officers'. So, at this point in time, we are not required to submit any report to any of the authorities.

As far as my knowledge goes, this has already been notified in the official Gazette, probably the date is 23/04/2013. However, I have no idea about the appointment of District Officers.

Of course, this Act has been enacted and notified in the Government of India Gazette on April 23, 2013. However, what about Section 1(3) of this Act, where it is written that this Act shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint? What does it mean? Do we require any specific notification from the Central Government on the date of its applicability?

This Act shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. We are waiting for this notification for its applicability. Rules are yet to be framed and notified. At present, we are not required to submit any report to any officer under this particular Act.

You need to check with the relevant state government as the "District Officer" is to be appointed by them.

Dear Team,

Please be advised that we have established a Sexual Harassment Policy since 2014, and we have a Committee in place for our organization located in Mumbai. We file our Audit Report yearly, in which we mention the enforcement of the Sexual Harassment Policy. Could you please advise if there is any specific yearly report that needs to be submitted for Sexual Harassment to any District Officer, even though we have not received any complaints regarding the same?

Dear Yashoda,

In accordance with Section 21 of the Sexual Harassment of Women at Workplace (PP&R) Act, 2013, the Internal Committee is required to submit an annual report to the Employer and the District Officer, even if there is no complaint of sexual harassment received during the year.
