As per law, what are the Maximum working hours in a week for a company in Mumbai???

First we are to see which of the Act is applicable to your establishment regarding working hours & other conditions of work like Bombay Shops Act, Minimum Wages Act, 1948 & Factories Act, 1948 etc. and then go through that applicable Act for your query. In general, it is 48 hours in a week without overtime.

Would the maximum hours still differ? Which Acts will be applicable to them??

not more then 10 hour in a day or 58 hour in a weak or 8 hour par day +50 ot hour in a quarter

This 48 hours in a week with rest of interval or without rest of interval .

Dear Mr AK Sharma,
This is without rest interval. Provisions relating to working hours(daily & weekly),spread over, rest intervals etc. should be seen in the applicable Act.

Your client's establishment is covered by the Bombay Shops and Establishments Act 1948. In terms of the said Act, the daily working hours shall not exceed 9 hours with rest interval of atleast one hour, subject to the maximum of 48 hours in a week. the spread over shall not exceed 11 hours on any day.

The Bombay Shops Act is applicable to an establishment which includes a shop, commercial establishment hotel or restaurant etc.Sec.2(4) of the Bombay Shops Act defines commercial establishment as one that carries on any business trade or profession or any work connected with such business or trade and includes an establishment of medical practitioners,architect or engineer etc.Thus the Shops Act covers a medical practitioner's establishment providing medical services with the help of some employees. However, the law excludes a medical practitioner's establishment from the definition of commercial establishment.

Dear All,
I also felt many a time most of the queries coming from our forum members are for fundamentals or basic acts references. They seem to not prepared to refer the Acts in their possession or browse thro' the Web sites where everything is available. They consider ourselves either a ready reckoner or their secretaries. Queriests pl. pl. take some time to refer to the respective Bare Acts/case laws in the sites first and if there are some critical or confusing areas then only come to the forum for clarification/opinions.
