Quitting After 2.5 Years: Can I Still Get Retrenchment Compensation?

jaspalnegi87
Dear Seniors, if a workman has completed 2.5 years of service and he himself wants to quit the job, is he eligible for any retrenchment compensation in this case? Please clarify.

Regards,

He is eligible only for leave pay/leave wages for the days he worked, i.e., 1 day of leave pay for every completed 20 days of work. Except for his leave wages, he is not eligible for any other pay (notice pay or retrenchment compensation).

When you are not retrenching the workman, why would you pay any amount of retrenchment compensation to this workman? He is not eligible for any retrenchment compensation in this case.

No, Jaspal, don't ever think of doing it. My suggestion to you is to first try to understand what the term "retrenchment" means. Refer to the I.D. Act.
