Is this 12-hour shift spread over timings of a shift or are these the actual working hours? We are required to examine the applicability of the Act under which our working hours are regulated and then review that Act to see the shift timings, actual working hours, and rest interval timings.

As per the Factories Act 1948, the maximum working hours, including breaks, should not exceed 10 hours and 30 minutes in a day. The maximum working hours per day are stipulated as 9 hours and per week as 48 hours. There should not be any discrimination among skilled and unskilled workers.

Regardless of the industry, working hours should not exceed 48 hours per week and 9 hours per day. If the hours worked surpass this limit, the workers must be compensated with double overtime wages. However, in factories in Gujarat, the government itself imposes restrictions on allowing overtime work.

According to the Factory Act, the standard working hours are 8, but they can be extended by providing notice/information to the labor office.

Hi Dear HRs,

What is the rule on software companies that make employees stretch beyond 8 hours? A reason for inefficiency is cited in most cases. Can the employee still take up the issue with HR if the manager forces the employee to work beyond 9 hours citing emergency problems?
