Can I know what the leave policy is for a manufacturing company as per the Factories Act? How many SL/CL/EL are provided, and what is the eligibility?

Dear Devi, It is correct that the Factories Act, 1948 provides us with the provisions of annual leave with wages in Chapter VIII of this Act, while CL & SL are allowed under the State Industrial Establishment (National & Festival and Casual & Sick Leaves) Act. Therefore, go through this Act for these leaves. After going through these minimum statutory leaves, you may go through the leave policies provided at different threads and prepare this as per your requirement. I would like to know whether 2nd Oct is a mandatory holiday. We are a manufacturing company located in Mumbai, and we do not have 2nd Oct as a holiday. Kindly revert with your valuable views.

Dear Coolchini,

As we all know, 2nd October is a national holiday, and the provisions relating to the grant of national holidays are governed by the State Laws. This is either under the State Industrial Establishment (N F holidays and C & S leaves) Act or the State Shops & Establishment Act. Therefore, first, decide which of the acts is applicable for the grant of the National Holiday, and then review the applicable Act to understand the consequences of not granting this holiday.

You can keep your factory open, but on those days, you need to pay double salary to the employees. Only on 15th August and 26th January do you need to close. On all other national holidays, you can keep the factory open as FMCG laborers are involved, and manufacturing cannot be stopped. We apply the same rule for our garment printing division.
