Is It Legal for Companies to Skip Casual and Sick Leave? Urgent Help Needed!

Casual Leave/Sick Leave is Compulsory??

Pls suggest me: In my company, there is no Casual Leave/Sick leave. Only 16 days PL are given. Is it legal? Also wanted to confirm the rules in this regard. If CL/SL is compulsory, then how many should be given. Please help urgently.

Hi,

In my opinion, providing CL/SL is not mandatory; however, a certain amount of leave needs to be given by all corporates as per the Shops and Establishments Act. You need to check the same for your state and demand the same accordingly from the management. CL/SL are just classifications of leave managed by HR. Mostly, leaves are granted on a pro-rata basis, i.e., one leave for every 20 days of work.

In the Factory Act of 1948, it is mentioned that one should be given one leave for every 20 days of presence on duty. There is no mention of CL/SL types.

You are correct in stating that the Factories Act, 1948 only has a chapter on annual leave with wages, but the subject matter relates to the granting of statutory CL & SL.

Though not mandatory, the classification of CL/SL is good for a company as it keeps scope for the basic human requirement of flexibility in on-the-job attendance. It also ensures that a limit is set on the employees as to the cause and scope of leaves available and avoids undue absenteeism if coupled with a good leave encashment system in the company.
