Understanding EL and Rest Days: How Do Factory Rules Apply to Weekend Absences?

Any worker who is on EL on Saturday and Monday will be treated as a rest day or EL on Sunday?

Please also clarify if any employee who is absent on Saturday and Monday will be treated as absent or have Sunday considered as a rest day?

Please provide a specific answer as per the factory law and UP FACTORY RULES 1950.

If he is availing Saturday and Monday as EL, the in-between Sunday will be treated as EL only. If he is absent on Saturday and Monday, the in-between Sunday will also be treated as absent.

Normally, in the case of LOP, only Sunday is taken into account. If the leave balance is available, then Saturday and Monday shall also be considered for counting the leaves.

If any employee is absent on Saturday and Monday, this will attract an EL, and Sunday will be exempted. So, two days EL will be deducted. It is a general leave rule. However, it purely depends on the industry as per the leave procedures.

As per the Factories Act, Sunday will not be counted as leave, and Saturday and Monday will be considered as two days of leave. This information is clearly mentioned in Section 79, Explanation 2 of the Factories Act.

Malikji is perfectly right, as usual. This is the legally compliant policy adopted by good companies and PSUs. However, many private sector companies, especially those that are small and family-run and do not have employer-friendly policies, follow the method as posted by Mr. Ponraj to extract as much benefit as possible.
