Dear Gurpreet Singh,

As Mr. Kapil has advised, first decide on the appropriate government entity, and then review the relevant rules of that government relating to the Contract Labour (R&A) Act, 1970. You will find all the necessary forms in these rules.

Dear Gurpreet Singh,

Formats of all the returns are available at the city bookstores that keep the registers under the Factories Act. If your unit is situated in Gurgaon, you can obtain all these forms from Nand Book Stall, Sadar Bazar, Gurgaon.

Hello Mr. Khola,

Could you please confirm whether the count of contract labor affects the principal employer in any situation? For example, if the principal employer has 4 contractors but the total number of contract laborers does not exceed 20, does it affect the principal employer?

Dear Kapil Dev Singh,

According to the Contract Labour (R&A) Act, 1970, the Principal Employer (PE) will have to obtain a Registration Certificate from the Registering Officer since the total number of contract laborers exceeds 20, considering the total of all the contract laborers engaged by the four contractors. However, at the same time, the four contractors are not required to obtain a license as, in their individual capacity, they are not employing 20 or more contract workers. The PE will also need to comply with other requirements of the Act and the Haryana Contract (R&A) Rules, 1975, pertaining to the maintenance of records, submission of annual returns, etc.

Opinion submitted as requested.

Dear All,

In short, for Contract Labour, please refer to the book "Law relating to Contract Labour" written by Alok Bhasin and published by Eastern Book Company. This book is available in two volumes consisting of the bare act, rules, state amendments, forms, the format of challan, and returns under the Contract Labour (R&A) Act-1970.

Dear Mr. Khola,

My query is, if the number of contract laborers does not exceed 20 even after including all contractors' labor, what should the Principal Employer do under the Contract Labour (R&A) Act? Does it still have an effect on the PE?

Please suggest.

Thank you.

Dear Rajendra,

It's a great pleasure to have people like you associated with us here. The information is really helpful. Hence, I require formats and procedures for maintaining the HR MIS, which should show the complete information of present strength, turnout, and new joinings, etc.

Also, please send me the duties and responsibilities for an admin manager, in detail.

Dear Kapil Dev Singh,

In that case, the employer has nothing to do under the Contract Labour (R&A) Act. Moreover, I would like to add one thing here: if the work being performed through contract labour is prohibited by the appropriate government by notification in the official gazette, then you are not to engage the contract labour on that particular work.

Hi Pals,

I am attaching an Excel file containing details on the Factory's Act (Sections, Schedules, Forms, etc.). Although it has certain provisions pertaining to the State of TN, by and large, it is common to all the states in the country.

Jalaj Sahu
Dear All,

I want to know the ratio of contract labor engagement in any manufacturing unit in Haryana. In what ratio or proportion can we engage contract labor in the organization as compared to permanent labor? The Contract Labor Act defines only the prohibition of contract labor in any organization but does not define the engagement ratio in the manufacturing unit. Haryana labor policy is also not clear about this. If there is a provision, please provide the references as well. I urgently require this information, so please help me.

Regards, Jalaj
R.N.Khola
Dear Jalaj,

In this situation, you are advised to contact the office of the Registering & Licensing Officer under the Contract Labour (R&A) Act in your area to gain knowledge on the subject.

It is current practice that my company is issuing Form V to subcontractors, which I think is not a correct practice. As per the Contract Act, the principal employer will issue Form V to the main contractor. For subcontractors, it is the contractor's responsibility to issue Form V. (Please correct me if this is not the case.)

Please let me know how I can convince my management regarding the same, and also inform me of any legal implications of this.

Compliance Requirements for Contractors Under CLRA Act

If contractors have obtained the Contract Labour License under the CLRA Act, 1970 for providing security and housekeeping services to a registered factory under the Factories Act, 1948, which scheduled employment wages should be paid by the contractor? Should it be under the Factories Act or the Shops Act?

Which records and registers are to be maintained by the contractor? Should it be the register under the Factories Act or under the CLRA Act/Minimum Wages Act?

A line in reply is appreciated.

Regards
R.N.Khola
Compliance with Minimum Wage and Labour Laws

In our opinion, you are required to pay the minimum rates of wages applicable to the unit where your workers are employed. If your workers are working in any unit covered under the Factories Act, 1948, along with the Minimum Wages Act, 1948, and the Payment of Wages Act, 1936, then you must maintain all registers and records related to these Acts without duplication.

In Haryana state, under The Haryana Contract Labour (R&A) Rules, 1975, Rule 77(d) states that if registers such as the muster roll, register of wages, overtime, deductions, fines, and advances are maintained under this Act, there is no need to maintain these registers under the Payment of Wages Act and the Minimum Wages Act. Therefore, it is essential to review all applicable Acts and Rules and maintain registers without duplication.
