Dear All, Our establishment is a Hotel Industry and which will be covered under Shops & Establishment Act.
Now which Minimum wages does it Apply - Shops & Commercial Establishment or the Hotels and Restaurants and Eating Houses:?:
if Hotels Restaurants and Eating Can anyone Send me the Minimum wage applicable w.e.f 01.04.2009. if do have the soft copy of the gazette can u please attach.

The minimum wage notifications are different for each state as they are issued by the respective state governments. So firstly you need to mention which city/state you belong to so as to corner the requirement.

To answer the specific question, the minimum wage notified for Hotel and Restaurant will be applicable and not the commercial establishments.

The attached minimum wages effective from 1st April 2009 to 30th Sep 2009.

If we are covered under Hotels & restaurants & Eating Houses then the same wage will be applicable to all the Contractual staff working under us like House Keeping, Horticulture, Security, and others. please confirm.......

Can any one let me know what actually is "Minimum Wages Act" for whom these act is covered? Are Doctors, Engineers, Software Professionals, School & College Principal, Dean, IT & ITES/BPO employees, Computer Operator, Data Entry Operator, Data Conversion Technician, Rickshaw Pullers, Cart Pullers, Bus driver and Conductor etc are covered or not. Is this Act applicable only to Rural Areas or also to Urban Area. Why this Act was formulated? And how and what basis is the calculation done? Is there any major changes done in this Act in the Current year? What is the benefits to the common people from this Act?

Not necessarily. The minimum wages are fixed for specific nature of job. You pl. go through the schedules. For Security there is different rate.

To understand Minimum wages, you must understand basic concepts in wages

It is difficult to explain here but I suggest you read articels on three areas

1. Living Wage

2. Minimum Wage

3. Fair Wage

It is the objective of any govt to take the society to what is called Fair Wage level

But in an Underdeveloped economy, we come across with bare sustainable wage levels This means the wage paid should be sufficent to get food and little clothing and a bit o accommodation.

Fair wages will not only take care of bare sustainable wages but also will aim at improving standard of life. Quality of life is critical.

When countries move from Underdeveloped to Developing, one can not drive wages all of a sudden to Fair level and it is the responsibilty of the Govt to take the wages to a reasonable level which is called Minimum Wages

This explanation is very basic for you to get some theoretical input and this does not try to deak with technical issued involved. With this as a back drop if you read some articles and some old Supreme Court Judgements given in 1960s and 1960s you will understand the concept much better
