Is Special Permission Needed for 24-Hour Shift Work in an MNC? Seeking Guidance

I am working in an MNC in 3 shifts for 24 hours. Please let me know if any permission is required for 24-hour working. If required, please inform me from which department it should be obtained. We already have a license under the Shops and Establishment Act.

For factory deputy director of factories will approve Form 11. In the case of Delhi, Chief Inspector of Factories will approve Form 11, which is made for shift timings.

As you have mentioned that your unit is covered under the Shops Act, therefore, it is hereby advised that you go through your State Shops & Commercial Establishment Act where your unit is located to review the provisions regarding the non-applicability of opening and closing timings as well as the designated close day for your specific nature of work. If these aspects are already permitted, there is no need to seek approval from the Chief Inspector of shops for exemption. However, if not, it is recommended to apply to the Chief Inspector of Shops of the State.

Yes, of course, you have to inform the chief inspector of Shops & Establishments and provide the reason for running in shifts. The inspector will verify the genuine reason, and if the inspector finds a real need for three shifts, then they will approve it.

In the case of women employees, please keep in mind that you have to arrange necessary safety measures for them. Many MNCs work in shifts, and a chief inspector visits during different shifts to assess the working conditions. Therefore, you should have sufficient arrangements to run a factory smoothly in shifts.

Please remember that working hours should not exceed 8 hours per shift, including lunch, tea, and dinner breaks.

Don't tell me that you work 24 hours in a day. How is it possible? According to the law, there are some time limits. Please follow the time limit.

Dear all,

In our telecom industry, we have sales outlets registered under the Shops and Commercial Establishment Act, and we are exempted from the weekly holiday requirement under the aforementioned act. We are now planning to set up an outlet for call center operations for a client. The client will utilize the premises from 9 pm to 9 am, with 20 people working overnight and the premises occupied by the client only during the night.

Given the circumstances outlined above, do we need permission from the labor department? If so, could you please guide us on the detailed procedure to obtain permission from the appropriate authority? Please note that there are no female employees.

You can approach the concerned labor commissioner of the respective state under which your establishment is covered and registered. There are provisions in every Shop and Commercial Establishment Act for the exemption of the operation of certain provisions. Alternatively, specify the state in which you are operating your business.
