Hi, The nominee of the deceased employee has to apply for Gratuity with the employer, providing proof that he/she is the nominee. Employer's Responsibility for Gratuity Payment Employer, if covered under a Group Gratuity scheme, can make payment through LIC or wherever covered. If not, it is the responsibility of the employer to release the Gratuity payment.

If the poster is the nominee, they can approach the employer with necessary identification proof to claim the gratuity amount for the deceased employee. In the absence of a nomination, they must make the claim with a legal heir certificate issued by the Revenue Department. In case of multiple claims by more than one legal heir, the employer will deposit the amount with the Controlling Authority under the Payment of Gratuity Act, 1972, for disbursement after an inquiry.
