Employee Continues Work With Same Director More Than 5 Years But At Sister Concern Company So He Is Applicable For Gratuity Or Not

As far as Payment of Gratuity as per the Act is concerned, the question is whether the employee has worked in the same establishment or not. The employer or Director is the same is not material. Subject to other eligibility as per the Act, if the continuous service in an establishment is five years or more then gratuity is payable.
