My friend left his job at a company on 18th Feb 2021 due to personal reasons and joined another company on 25th Feb. Now, his old company has given him the Full and Final Settlement (FNF) and Form 16 with the date mentioned as 19th Feb, but on the relieving letter, it's mentioned as 3rd March. His current employer is accusing him of dual employment and has asked him to resign immediately or they will terminate him. They are requesting him to resign first because he is a highly skilled person and has never committed any kind of fraud in his life.

In this situation, it is crucial for your friend to address the discrepancy in the relieving dates between the documents provided by his previous employer. Here are the necessary steps he should consider:

1. Gather Evidence: Ask the previous employer to provide a revised relieving letter with the correct date to avoid any misunderstandings.

2. Explain the Situation: Your friend should transparently explain the sequence of events to his current employer, detailing the actual dates of resignation and joining the new company.

3. Legal Consultation: If the issue escalates, seek legal advice to understand the implications of the discrepancy and the accusations of dual employment.

4. Negotiation: Initiate a discussion with the current employer to resolve the matter amicably. Offer to provide any additional information or documentation they may require.

5. Professionalism: Throughout the process, maintain professionalism and emphasize your friend's commitment to his work and integrity.

6. Future Precautions: Ensure all future employment-related documents are accurate and aligned to prevent similar issues in the future.

By addressing the discrepancy promptly, providing clarity, and cooperating with both employers, your friend can navigate this challenging situation effectively.
