Hello, I recently joined TCS. During the BGC process, my previous company provided some negative feedback because I left the company without serving the notice period. Currently, TCS requires a full and final settlement email with positive remarks. However, it is not feasible at the moment. What steps can I take in this situation?

Importance of Serving Notice Period in Employment

Any formal employment has its own set of rules right from the stage of application for the job to its termination. When a notice period for resignation is prescribed, you cannot simply send your resignation by any means and walk out of the job to join another one. Unless you are formally relieved by your previous employer after accepting your resignation, you are deemed to be in service but absconding. As such, your joining another job would be treated as dual employment by both employers, and eventually, you will lose both jobs.

It is better to approach your previous employer, apologize unconditionally, remit the notice salary if insisted, and obtain the proper documents of your exit.

Thank you for your reply. However, my previous company has already given me a release letter and last month's salary as well. They released me with the proper format for the background check process but unfortunately provided a negative response. What can I do in this situation? My previous company has informed me that they will not be issuing any further documents.

The Role of Ex-Employer Feedback in BGV Process

The response of an ex-employer in a Background Verification (BGV) process need not necessarily be taken as sacrosanct by the new or prospective employer. Particularly, the allegation of jumping the notice period becomes irrelevant when the ex-employee was formally relieved of their position with just a plain relieving letter, without mentioning anything about it. However, it depends on how the new employer interprets such negative feedback.
