Dear Sunita,

Your query is too short. What is the nature of your employment? In which department do you work? Does your job require wearing a uniform? When you were employed, did the employer declare the conditions of the employment, and has it been clearly mentioned in your appointment letter?

Women employees working in the hotel industry, airlines industry, hospitals, etc., are required to wear a uniform. As part of the uniform, they are not allowed to wear the bindi and bangles. Again, it is a case-by-case basis, and there cannot be generalization as such.

Regarding filing a suit against the employer, it is fine. The court's verdict will depend on whether the employer has violated religious freedom. For example, male Sikhs are allowed to wear a turban or a ring on their wrists (kangan) because it is a part of their religion. If the suit is filed, then the lawyer must be able to prove that wearing a bindi and bangles is a part of Hinduism or any other religion. Court verdicts are not based on accepted practices, but there has to be evidence in religious texts.

Filing a suit against the employer is fine, but the employer may consider the employee a maverick and may start harassing through other means. Therefore, is the employee ready to take that risk?

Thanks,
Dinesh Divekar
