hi sir, my name is Dimple and i m a third party contractual staff. Appraisal of 2017-2018 is going on in my organisation. But my Hr people are saying that i m not eligible for this due to maternity leaves but my maternity period starts from march 2018 and appraisal is for April 2017 to March 2018 in which i served to the company. Kindly advise what would I do now

Understanding your scenario, Your contractual appointment terms and conditions applies, so first check your employment conditions for appraisal process, if your clause says your are eligible for appraisal then your HR has no right to deny your appraisal for the reason of maternity.
This kind of situation should handle by mutual understanding between you and your management, if we suggest you to go for legitimate way then you may have the chances of loosing your job.

But sir i served for that period and after that i was on maternity leave. And i joined after one year as a rejoiny employee. So as per my understanding the period i served i am eligible for the appraisal.

Hi,
Some companies do like this either delay the increment or release less increment for maternity cases. While your question is right employer perceive the maternity leave as non productive period which is not ethical. Please discuss with your immediate superior/HR about the contributions made and arrive at some solution at least reduced increment instead of nil increment.

We know that you are entitled for the benefit but we can not neglect that, your management is doing all this deliberately. So you have a two ways infront of you, either look some other job or discuss with your management directly about this issue else fight legally with them.

From your narration it is learnt that you joined company after one year after maternity leave again. I find if see through you in 19 that there has been gap now to go back 17-18 for appraisal. Your company offered re-employment whatever your performance was but certainly it was right fit so good to get you employment there same place.It is worth appreciation and you must have positive thinking without guzz grumble and and keep hard work with your behaviours and contribution always. It will happen in years onward as nobody can have denial to great work and I wish your grievance of 17-18 will get genuinely addressed to your satisfaction.

In addition ato above view points and as said Ravi, you can attempt pick up another job which is option now and any time. But we are not advising you to go to your present Management with evidence , the reason is understood . You can informally discuss anytime at this point of time to your immediate Boss and get him into communication loop. Please understand carefully the risk and future games while also appreciate, there is no company which will reopen 17-18 appraisal in 19 even if there is some thing bad has happened to the employee.

Dear Friend,
There is a law on minimum wages but there no such law on increment/appraisal, your appointment letter mentioned clause will help you to produce proof infront of your management.
Ask them, anywhere it is mentioned in you appointment letter, if any eligible employee proceeds for maternity during appraisal or after appraisal such employee is not eligible for increment.

Sir i agree with your point but appraisal is going right now some employee got appraisal amount but some of them are in process. So when i asked my management for my appraisal they are saying you are not eligible only current employees are eligible.

Hi,
In this case you are eligible for Appraisal, because law only permit to take maternity Leave.
if you have taken more then Maternity leave in that case you will not eligible, here management have right to deny.
